Lately our firm received many eviction inquiries from both tenants and landlords. Nebraska Governor Pete Ricketts signed an executive order. The order defers residential landlord’s rights to terminate a rental agreement because of unpaid rent under Neb. Rev. Stat §76-1431(2) or Neb. Rev. Stat. § 76-14,101(2) as long as the tenant can show he/she:
suffered a substantial loss of income as a result of COVID-19 impacts, or
( missed work to care for family due to facility closures related to COVID-19.
Under this new order, landlord cannot evict a tenant or persons living with a tenant who have been suspected or diagnosed of COVID-19 until May 31, 2020. However, tenants shall have an obligation to pay their rent. Landlord can also terminate a rental agreement for other reasons not related to unpaid rent.
