Nebraska Eviction Relief Until May 31, 2020

Lately our firm received many eviction inquiries from both tenants and landlords. Nebraska Governor Pete Ricketts signed an executive order. The order defers residential landlord’s rights to terminate a rental agreement because of unpaid rent under Neb. Rev. Stat §76-1431(2) or Neb. Rev. Stat. § 76-14,101(2) as long as the tenant can show he/she:

  1. suffered a substantial loss of income as a result of COVID-19 impacts, or

  2. ( missed work to care for family due to facility closures related to COVID-19.

Under this new order, landlord cannot evict a tenant or persons living with a tenant who have been suspected or diagnosed of COVID-19 until May 31, 2020. However, tenants shall have an obligation to pay their rent. Landlord can also terminate a rental agreement for other reasons not related to unpaid rent.

Local county courts are still processing filed evictions occurred before March 13, 2020. To view the full context of the Executive Order, click here.
